About these terms

These terms cover the Mote website, the reservation of a Cuff-01, and the Mote app once the cuff ships. By reserving a cuff or using the site you accept them.

This site is a concept template. The company details, prices and dates below are placeholders and must be replaced, and the whole document reviewed by a lawyer, before it is used for a real sale.

Reserving a cuff

A reservation holds a place in a production run. It is not a completed sale: we take the reservation amount shown at checkout, and the balance is only charged when your cuff is ready to ship.

Reservations are limited per person and per run. If a run closes before your reservation is confirmed we refund the amount in full.

Shipping and dates

Any ship window we show is an estimate for a run, not a promised date. Hardware slips. If a run moves by more than a month we tell you, and you can cancel for a full refund.

You are the importer of record. Duties and import taxes are yours unless the checkout says otherwise.

Cancelling and refunds

Cancel a reservation any time before it ships and we refund it in full, no reason needed. After delivery you have 30 days to return a cuff in working condition for a refund of the price paid, minus return shipping.

Nothing here limits any statutory right of withdrawal you have where you live.

What the cuff is, and is not

The Cuff-01 records only while the stone is held, and reads signals from your ear to describe your day. It is a consumer product. It is not a medical device: it does not diagnose, treat or monitor any condition, and nothing it shows you should be used to make a medical decision.

If something about your health concerns you, speak to a doctor rather than to a wearable.

Recording and other people

A press records audio around you, and that may include other people. You are responsible for using the cuff lawfully where you are. Recording laws differ by country and by state, and some places require every person in a conversation to consent.

The light on the stone is on whenever the cuff is capturing, precisely so the people near you can see it.

Your recordings and your data

Recordings are processed to produce your evening card and are stored against your account. You can export or delete them at any time, and deleting an account deletes the recordings with it.

We do not sell recordings or the text derived from them, and we do not use them to train models for anyone else. How we handle personal data in detail belongs in the privacy notice.

Warranty

Hardware carries a two year limited warranty against manufacturing defects from the delivery date. It does not cover water damage beyond the stated rating, crushing, or a cuff that has been opened.

Your statutory warranty rights, where they are longer or stronger, apply on top of this one.

Fair use of the service

Do not resell access, take the service apart to rebuild it, or use it to record people unlawfully. We can suspend an account that does, and we will say why.

Liability

We are responsible for loss we cause by breaking these terms or by negligence. We are not responsible for indirect loss, or for loss caused by using the cuff in a way it was not meant to be used. Nothing here excludes liability that cannot legally be excluded.

Changes

We can change these terms; the date at the top says when they last moved. If a change materially affects an open reservation we tell reservation holders before it takes effect, and you can cancel for a full refund.
